These terms set out the conditions for using the apps below and related services (the “Service”) provided by Haruda (the “Company”). By using the Service, you agree to these terms.

Scope

  • Haruda Focus Android io.haruharu.pomodoro · iOS im.haruda.focustime
  • Haruda Alarm Android io.moka.dayday_alrm · iOS com.haruda.alarm
  • Haruda Ritual Android · iOS com.haruda.ritual

1. The Service and your account

The Company provides habit tracking, a focus timer, and alarms. The basic features are free and can be used without signing in.

Signing in is optional. It is used to sync the same records across devices and for features that need an account (such as Together and the auto-calculation bots). You can delete your account at any time in the app’s settings or on the account deletion page, and the records stored on our servers are then promptly deleted. Information we keep as required by law, and other handling of personal data, follow the Privacy Policy.

3. Withdrawal and refunds

Payments are processed by the App Store and Google Play, so refunds follow the policy and procedure of the store where you paid (request a refund from Apple · Google Play refunds). If the store’s procedure doesn’t resolve a problem, let us know at steady.moka@gmail.com.

Paid services are intangible digital content, and we start providing them as soon as you confirm a purchase. So once provision has started, you can’t withdraw from the purchase (cancel or return it) for personal reasons, to the extent permitted by law.

However, these terms don’t limit your legal rights to withdraw or get a refund, such as for any part that hasn’t started to be provided, or when the Service is provided differently from how it was displayed, advertised, or contracted.

Users in Taiwan: paid services are digital content not provided on a tangible medium. Paid services whose purchase screen gives you this notice and asks for your consent (currently Haruda Ritual subscriptions) start as soon as you agree and confirm the purchase, so under Article 2, Item 5 of the Regulations Governing the Reasonable Exceptions for the Application of the Right of Withdrawal in Distance Sales, the 7-day right of withdrawal under Article 19, Paragraph 1 of the Consumer Protection Act does not apply to them. If you don’t agree, you can choose not to buy. Paid services whose purchase screen doesn’t give this notice remain subject to the 7-day right of withdrawal.

4. Your content

You own the records and memos you write. The Company stores and uses them only as needed to sync across devices, back them up, and run the features you request.

If you turn on an auto-calculation bot in Haruda Ritual, the memo text of the chosen habits is processed by servers and computers operated by the Company and by Anthropic’s AI API to estimate values (Privacy Policy, Section 6). This processing is limited to the habits the bot is turned on for and isn’t used for ads or user profiling. Values estimated by the bots are for reference only and are not professional advice, such as medical or nutritional advice.

You are responsible for the nickname, space names, and cheers that other users see in Together in Haruda Focus. The Company may review reported content and remove it or restrict the user’s use of Together.

5. License and prohibited conduct

The Company grants you a limited, non-transferable right to use the Service for personal, non-commercial purposes. The Company owns the rights to the Service and the software, trademarks, and designs in it. The following are prohibited:

  • Reverse engineering the Service, or copying, distributing, or selling it without permission
  • Using another person’s account without permission or interfering with the operation of the Service
  • Harassing other users or sending abusive, discriminatory, or obscene content
  • Using the Service to break the law or infringe the rights of others

If you violate these rules, the Company may restrict your use of the Service or suspend your account, depending on how serious the violation is. Unless it’s urgent or we have no way to reach you, we’ll tell you the reason in advance and give you a chance to respond.

6. Changes to and discontinuation of the Service

The Company may change parts of the Service, or discontinue all or part of it. Before changing key features of a paid service in a way that’s less favorable to you, or discontinuing anything that affects paid services, we’ll give at least 30 days’ notice through the apps or website. Refunds for any remaining period follow applicable law and the store’s policy.

7. Limitation of liability

The Company works to provide the Service reliably, but doesn’t go so far as to guarantee that it will be uninterrupted or error-free. The Company takes reasonable protective measures and isn’t liable for damage that occurs without its intent or negligence (such as data loss from a lost or broken device or from your own deletion). We recommend keeping a separate copy of important records.

Only where you suffer damage due to the Company’s ordinary negligence (negligence that is neither intentional nor gross), the Company compensates the damage that would ordinarily arise, and compensation relating to a paid service is limited to the amount you paid for that service (for a subscription, the amount paid in the 12 months before the day the damage occurred; for a one-time plan, its purchase price; for a plan received as a gift, the purchase price of that gift).

The exclusion and limits in this section don’t apply to damage caused by the Company’s intent or gross negligence, or to liability that can’t be excluded or limited in advance under applicable law.

8. App stores

These terms are an agreement between you and the Company; Apple Inc. and Google LLC are not parties to it. The terms of the store you got the app from also apply.

  • Scope of license: an app obtained from the App Store may be used on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including use by other accounts associated with you through Family Sharing or volume purchasing).
  • Maintenance and support: the Company alone is responsible for maintaining and supporting the Service, and Apple has no obligation to provide any maintenance or support.
  • Warranty: if the app fails to conform to any warranty the Company gives or that applies by law, you may notify Apple, and Apple will refund the app’s purchase price to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation regarding the app, and any other claims, losses, damages, or costs attributable to a failure to conform to a warranty are the Company’s responsibility under these terms.
  • Claims: the Company, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws. If a third party claims that the app or your use of it infringes their intellectual property rights, the Company, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
  • Legal compliance: you represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party terms: you must comply with applicable third-party terms (such as your wireless data service agreement) when using the Service.
  • Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
  • The Company’s name, address, and contact information are given in Section 11 (Contact).

9. Changes to these terms

The Company may change these terms within the limits of applicable law, and a change must either suit the general interest of users or be reasonable in light of the need for it, the appropriateness of the new content, and other circumstances. We’ll announce the changes, the reasons, and the effective date through the apps or website at least 7 days in advance, or at least 30 days in advance for changes that are significant or less favorable to you, and we’ll also notify you separately of less favorable changes, such as by an in-app notice or email. That notice will tell you that if you don’t object before the effective date, you’ll be treated as agreeing to the changed terms; if you don’t object and keep using the Service after the effective date, you agree to the changed terms. If you don’t agree, you can stop using the Service and delete your account before that date (canceling and refunding subscriptions follow Sections 2 and 3).

10. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Korea. However, mandatory consumer protection provisions of the country where you live that can’t be excluded by agreement still apply. Lawsuits over disputes about the Service are filed with the court that has jurisdiction under the Korean Civil Procedure Act and other applicable laws, and these terms don’t limit your right as a consumer to sue in the courts of the country where you live. Where the meaning of these terms is unclear, they are interpreted in your favor.
